Seller Policy

Labels by ME  is a marketplace where you can sell the items you’ve made, designed, and handpicked, or sourced, directly to buyers around the world. We want to make sure that you and your buyers have a positive experience on Labels by ME. Please read on to find out more about your rights, as well as what is expected of you, as a seller.

Selling Basics

Keeping in mind these basic requirements will set you up for success on Labels by ME. If you sell on Labels by ME, you need to provide the following information for each of your items:

  1. An accurate representation of how the item was made, by whom, and where it is being shipped from.
  2. Your own photographs or video content —not stock photos, artistic renderings, or photos used by other sellers or sites.
  3. If an item is created through the use of artificial intelligence, you must disclose this in your relevant listings.

We encourage you to be transparent about how your craft and party supplies were made and where your materials come from. You can disclose whether your items have social or environmental attributes, such as organic or recycled. You can also select the location of manufacture.

Even if they otherwise meet our marketplace criteria, prohibited items, services, and items that violate our intellectual property policies are not allowed to be sold on Labels by ME.

All listings must offer an item for sale. You may not create a Labels by ME listing for the purpose of sharing a referral code, posting a want ad, crowdfunding, or similar activity that does not offer a physical or digital item for sale.

Labels by ME may remove any listings that violate our policies. We use a combination of automated systems, manual monitoring and flags from members and third parties to help us identify items that may violate our policies. Note that listing fees are non-refundable. Labels by ME may also suspend or terminate your account for any violations and you’ll still have to pay any outstanding fees on your Labels by ME statement.

Your shop represents you and your business to the Labels by ME community. It’s important that you, your items and your shop are honestly and accurately represented.

By selling on Labels by ME, you agree that you will:

  1. Provide honest, accurate information to Labels by ME.
  2. Honor your Shop Policies.
  3. Ensure your shop content, such as any text, photos or videos used to represent yourself, your shop or your listings, abide by Labels by ME’s policies.
  4. Accurately represent your items, including any details you provide about country of origin, provenance, attributes, components or materials, in listings and listing photos.
  5. Respect the intellectual property of others. If you feel someone has violated your intellectual property rights, you can report it to Labels by ME.
  6. Not facilitate off-platform transactions.
  7. Not create duplicate shops or take any other action (such as manipulating clicks, carts or sales) for the purpose of shilling, manipulating search or circumventing Labels by ME’s policies.
  8. Not coordinate pricing with other sellers.

Seller Standards By listing a product for sale on Labels by ME you understand and agree that you are responsible for complying with all applicable laws and regulations for the products you list for sale, including any required labels and warnings. Labels by ME assumes no responsibility for the accuracy, labeling, or content of your listings.

Meeting Service Level Standards:

As a seller, you must provide great customer service and maintain trust with your buyers. These requirements are called our Seller Service Level Standards. Labels by ME may reach out to you if your shop fails to meet Labels by ME’s Seller Service Level Standards.

By selling on Labels by ME, you agree to:

  1. Honor your shipping and processing times. Sellers are obligated to ship an item or otherwise complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance. Please be aware that legal requirements for shipping times vary by country.
  2. Respond to Messages in a timely manner.
  3. Honor the commitments you make in your shop policies.
  4. Resolve disagreements or order issues directly with the buyer. In the unlikely event that you can’t reach a resolution, Labels by ME can help through our case system. Read about your rights and responsibilities regarding cases.
  5. If you are unable to complete an order, you must notify the buyer and cancel the order. Read about how to cancel an order immediately.

 

Fees & Payments Policy

This Fees & Payments Policy explains your fees and taxes and how to pay them.

This policy is a part of our Terms of Use. By opening a Labels by ME shop, you’re agreeing to this policy and our Terms of Use.

Sellers may be required to pay the following types of fees. Please note that all fees are listed exclusive of any value-added tax (VAT) or similar taxes that may apply. See the Taxes section below for further details. It’s important to note that all service fees, including prepaid fees, are non-refundable.

Transaction Fees

When you make a sale through Labelsbyme.com, you will be charged a transaction fee of 6% of the price you display for each listing plus the amount you charge for shipping and gift wrapping. If you are a Labels by ME Payments user and you list your items in a currency other than your payment account currency, see the Currency Conversion section below for more details on the transaction fee. If you sell from the US, the transaction fee will not apply to sales tax. If you sell from anywhere other than the US, the transaction fee will apply to the listing price (which should include any applicable taxes that you as a seller are responsible for), shipping price, and gift wrapping fee. If you offer optional personalization for an additional fee, the additional fee for personalization is added to the listing price you display and the total display price is subject to the same transaction fees described in this Section. See the Taxes section below for more information about whether you are required to include applicable taxes in your listing prices. Transaction fees are deducted from your current balance as each sale occurs, and are reflected in your payment account.

Payment Processing Fees

Online Sales. Eligible Labels by ME shops may use Labels by ME Payments to accept certain payments through Labels by ME (learn more about Labels by ME Payments below). Payment processing fees are charged for each transaction made through Labels by ME Payments. Payment processing fees vary based on the location of your bank account. In certain markets, a fixed deposit fee may be charged for the disbursement of seller funds that are under certain designated thresholds. The payment processing fee is assessed on the total amount of the sale, including tax and shipping. Payment processing fees are deducted from the sale amount in your payment account. Deposit fees are deducted from your Available Funds and reflected in your payment account at the time of your scheduled deposit.

Shipping Fees

The cost of the shipping label will depend on the shipping carrier, and the origin, destination, weight, and dimensions of the package. If you add signature confirmation or insurance, those fees will be added to the total cost of the label at the point of purchase.  licensed insurance carriers. You are highly encouraged to select a dependable shipping courier and ship within 48 hours from receiving the order unless it is a custom made item that requires a long time to be produced. Labels by Me will not determine the cost of shipping and it is the seller’s responsibility to calculate all shipping fees and disclose them to the buyer.

Currency Conversion

With the exception of the set-up fee, the Payment Processing fee, Regulatory Operating fees, and deposit fees, Labels by ME converts fees from USD to your payment account currency at the market rate at the time the fee is reflected in your payment account. All fees appear in your payment account in your domestic currency. However, Labels by ME Payments users located in Bulgaria, Croatia, Czech Republic, Hungary, Poland, and Romania will have all fees deducted from their payment account in their designated payment account currency, the Euro.

To avoid incurring foreign exchange charges on your sales, Labels by ME recommends you list your items in the same currency as your payment account currency. Buyers see the items in the currency of their choosing. As a Labels by ME Payments user, if you decide to list in a currency other than that of your payment account, you will be charged a 2.5% currency conversion fee on the sale amount to send funds to your payment account. Currency conversion is handled automatically by our payment processing service.

2. Off-Platform Transactions

Buy and sell items safely and securely on Labels by ME. Off-platform transactions are not protected by Labels by ME’s secure payment platform or policies, and offers to buy or sell outside Labels by ME are a potential fraud risk for buyers and sellers. Therefore, any action to move a transaction off the Labels by ME platform is strictly prohibited by Labels by ME. This includes, for example, encouraging buyers to purchase an item in your Labels by ME shop through another venue or directing buyers to another venue via a QR code. A transaction initiated on Labels by ME may not be completed off of Labels by ME. The price stated in each listing description must be an accurate representation of the sale. Sellers may not alter the item’s price after a sale for the purpose of avoiding Labels by ME transaction fees, misrepresent the item’s location, or use another user’s account without permission.

3. Paying your Labels by ME Fees

Labels by ME will automatically deduct all fees owed from your payment account, with the exception of the set-up fee which is charged to your card when you complete onboarding.. Provided you have sufficient funds in your payment account no further payment action is required. If your payment account does not contain sufficient funds you are responsible for paying any fees owed in full within 15 days of the date of your monthly statement, or the account will be considered past due, and Labels by ME may charge your card on file or take other actions to collect the funds. If you make a sale while you have an outstanding balance the net sale amount will be applied to your outstanding balance. You may pay your outstanding balance manually by credit card, debit card, or PayPal.

Your statement is available in your payment account at the beginning of each month, and will detail all sales and fees activity from the preceding month.

 Suspended or terminated members remain obligated to pay Labels by ME for all unpaid fees.

4. Labels by ME Payments

Labels by ME Payments enables sellers to accept various forms of payment in their local currencies while using Labels by ME’s services. Sellers registered for Labels by ME Payments accept payment from buyers by major credit or debit cards accepted by Labels by ME, PayPal (where available), Apple Pay or Google Pay.

5. Taxes

A. Listing your items on Labelsbyme

To comply with applicable US tax laws, Labels by ME will calculate, collect and remit sales tax on your behalf for orders shipped to customers residing in US locations.

You are solely responsible for ensuring that all of your listings are properly categorized, and you agree to indemnify Labels by ME for any losses it incurs in connection with any miscategorization of your listings by you.

Please remember that Labels by ME’s fees do not include any withholding taxes that might apply in your home country. You are required to pay Labels by ME the full amount of our fees and may not deduct any applicable withholding taxes from that amount.

In certain jurisdictions, where required to comply with applicable laws, Labels by ME  may withhold taxes from payments made to you or on your sales made through Labelsbyme.com.

B. Taxes on Seller Services

US Sales Tax on Subscription Fees

Where applicable, state sales tax will be applied to the subscription fee charged by Labels by ME.

VAT on Seller Fees

Depending on your business status and location, Labels by ME may be required to apply VAT on seller fees charged each month and remit it to the relevant tax authority. VAT is collected on all Labels by ME fees for sellers located in countries where VAT should be applied. Note that fees listed in this policy are exclusive of VAT.

C. Taxes We Collect and Remit from Buyers

United States Sales Tax

In most US states, as applicable, Labels by ME will collect the sales tax amount from the buyer and pay this to the relevant tax authority. If the sale was made through Labels by ME Payments, the sales tax amount will appear in your payment account and is deducted from your current balance.

6. Other Governmental Fees, Charges and Levies

Certain jurisdictions may require Labels by ME to collect other fees, charges or levies (e.g., environmental fees) from buyers and to remit those amounts to the relevant governmental authorities. Where Labels by ME is required by law to collect such amounts, they will be charged to buyers at checkout.

7. Marketplace Reporting of Seller Information

Where legally required, Labels by ME will report your personal details and details of your transactions to relevant governmental authorities.

For US sellers, Labels by ME will issue 1099-K forms to certain sellers to comply with IRS and applicable state requirements.

Labels by ME will not disclose any personal information to any third parties unless legally required to do so.
